MLA Vinay Kulkarni Officially Disqualified from Karnataka Assembly After Life Sentence

The Karnataka Assembly Secretariat on Saturday (May 2) officially issued a disqualification order for Congress MLA Vinay Kulkarni of the Dharwad Rural constituency, following his conviction and life sentence in the Yogesh Gowda murder case. The Assembly Secretary declared the Dharwad Assembly constituency vacant, with Kulkarni's membership cancelled effective April 15 — the date his sentence was pronounced.

What the Law Says

The disqualification was issued under Article 191(1)(e) of the Indian Constitution and Section 8 of the Representation of People Act, 1951. Under these provisions, any MLA or MP convicted of a criminal offence and sentenced to a minimum of two years in prison is immediately disqualified from their seat. In murder cases (under IPC Section 302 or BNS Section 103), the minimum punishment is life imprisonment — far exceeding the two-year threshold — making disqualification automatic and immediate upon conviction.

Duration of Disqualification

Beyond losing his seat, Kulkarni is also barred from contesting any election — for the Assembly, Parliament, or otherwise — for six years after his release from prison. Following the Supreme Court's landmark Lily Thomas judgment (2013), disqualification takes effect immediately upon sentencing, with no three-month grace period for filing an appeal.

BJP's Criticism

The opposition BJP had sharply criticised the Assembly secretariat for what it called an undue delay in issuing the disqualification order after the sentence was pronounced. BJP leaders alleged the Congress government was giving Kulkarni time to approach the High Court and secure a stay before the official disqualification. With Saturday's order, all such possibilities have closed and Kulkarni is now officially a former MLA.

High Court Appeal

Kulkarni and co-accused Chandrashekhar Indi have already filed appeals in the Karnataka High Court, challenging the Special Court's order and seeking a stay on the life sentence along with bail pending the appeal.

Background — The Yogesh Gowda Murder Case

In 2016, Yogesh Gowda, a Zilla Panchayat member from Dharwad, was murdered. A total of 21 people including Vinay Kulkarni were named as accused. The BJP government handed the case to the CBI, which conducted a thorough investigation and filed a chargesheet. After ten years of continuous investigation and trial, the Special Court for People's Representatives convicted 16 of the accused on charges of murder, criminal conspiracy, destruction of evidence, assault with deadly weapons, and unlawful assembly. Two accused — Somashekhar Nyamagowda and Vasudev Nilekani — were acquitted.

Following the verdict on April 13, the convicted persons were taken into CBI custody, subjected to medical examination at Bowring Hospital, and transferred to Parappana Agrahara prison. On April 15, the court sentenced Kulkarni and 15 others to life imprisonment; Inspector Channakeshava Tinkarikar received a separate seven-year prison term.
